Entry into force of the Act amending the Capacity Market Act introducing supplementary auctions

On 14 February 2025, the Act of 24 January 2025 amending the Capacity Market Act (hereinafter “the Act”) enters into force. This Act introduces supplementary auctions in the Polish capacity market.
The changes introduced in this Act stem from the implementation of a derogation allowing high-emission units (not meeting the 550 g CO2/kWh emission limit and having started commercial production before 4 July 2019) to receive payments under the capacity market in the period from 1 July 2025 to the end of 2028. The derogation was introduced by Regulation (EU) 2024/1747 of 13 June 2024, amending Regulations (EU) 2019/942 and 2019/943).
In accordance with Article 3(3) of the Act, information on the organization or lack thereof of the supplementary auction for the second half of the 2025 delivery year will be provided no later than 31 March 2025.
For physical cross-border units, the first step is to submit offers in the pre-auction for the supplementary auction for the second half of the 2025 delivery year. The pre-auctions date announcement is expected in late February/early March 2025. Afterwards, it is necessary to obtain certification for participation in the supplementary auction. Certification for the supplementary auction for the second half of the 2025 delivery year is expected to take place in the second quarter of 2025.
